These Terms of Use (“Terms”) govern your access and use of the SongMaker.AI mobile application (“the App” or “the Service”), developed and operated by Hangzhou Xinglu Network Information Technology Co., Ltd. (“we,” “us,” or “our”). By downloading or using SongMaker.AI, you agree to be bound by these Terms.

1. Service Overview

SongMaker.AI is an AI-powered music creation app. Users can enjoy free features or choose paid options, including weekly and annual subscriptions or credits for enhanced generation.

2. Use Eligibility

The App is intended for users of all ages. However, if you are under 18, please ensure you have permission from a parent or legal guardian. Use of the App must be lawful and personal.

3. Content and User Input

You may only submit prompts and inputs that you have the legal right to use. You retain ownership of your input but grant us a non-exclusive license to process it for providing the Service. You are responsible for all content generated from your prompts.

4. AI-Generated Content and Intellectual Property Rights

The App allows users to generate music and audio using AI technology. You may use the generated content subject to applicable laws and third-party rights.

All intellectual property rights in the App itself, including its software, design, and AI models, are owned by Hangzhou Xinglu Network Information Technology Co., Ltd. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our express permission.

5. Prohibited Conduct

You agree not to:

  • Violate any laws or third-party rights using the App
  • Use the App to produce unlawful, violent, hateful, or infringing content
  • Use the App in a way that could harm or disrupt our infrastructure or reputation
  • Attempt to reverse-engineer, decompile, or interfere with the App

6. Subscriptions and In-App Purchases

The App offers optional paid features through:

  • Weekly and annual auto-renewing subscriptions
  • Credit-based packages for advanced AI features (e.g., V4.5 model)
  • Functional credits to unlock tools or extend usage

All payments are processed by Apple via the in-app purchase system. Prices are displayed in the App and may be adjusted at our discretion.

Subscriptions automatically renew 24 hours before the end of the current period at the same price and duration, unless changed. You can manage or cancel your subscription at any time via your iOS device or iTunes account settings.

Deleting the App does not cancel your subscription, but cancellation is still possible through the App Store settings after deletion. Auto-renewable subscriptions can only be canceled through Apple’s official system.

Subscription remains active until the end of the current billing cycle even after cancellation. All purchases are final and non-refundable unless required by law or Apple policy. For help, please visit Apple Support.

7. Disclaimer of Warranties

The App and any content it generates are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied.

We do not guarantee:

  • That the App will be uninterrupted, secure, or error-free
  • That the generated content will be accurate or suitable for your use
  • That the results will not be similar to those generated for other users

You use the App at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or content
  • Any claims related to your use of or reliance on AI-generated outputs

9. Changes and Termination

We may modify or discontinue the App or its features at any time without prior notice. We may also suspend or terminate your access for any reason, including violation of these Terms.

10. Apple App Store Terms

You acknowledge that this agreement is between you and us, not Apple. Apple has no responsibility for the App or its content. Apple is a third-party beneficiary of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of California (or other applicable US jurisdiction if required for Apple App Store compliance). Any disputes shall be subject to the exclusive jurisdiction of courts located in that region.
